These Terms of Service (“Terms”) are a legal agreement between you (“you” or “Customer”) and Rovehost, a California S-Corporation (“Rovehost,” “we,” “us,” or “our”). They govern your use of our website at rovehost.com and all hosting and development services we provide.
By creating an account or using our services, you accept these Terms. If you’re agreeing on behalf of a company, you confirm you have authority to bind that company.
Rovehost provides managed WordPress hosting, CDN delivery, daily backups, and optional AI development services through our partnership with DataStarters.com. The specific features included with each plan are described at rovehost.com/pricing.
You must be 18 years or older to create an account (or have a parent’s or guardian’s consent if younger). You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
Our plans and current prices are:
All plans are month-to-month with no long-term contract required. Payments are processed by Stripe or PayPal. Included AI development hours do not roll over to the next billing month.
Your subscription renews automatically each month on your billing date. We will charge the payment method on file unless you cancel before your renewal date.
You can cancel at any time from your account dashboard or by emailing [email protected]. Cancellation takes effect at the end of your current billing period. You keep access to your services until that date.
If you are not satisfied, request a full refund of your first month’s payment within 30 days of your initial purchase. This applies to the plan fee only. To request a refund, email [email protected] with your account email and the reason. Refunds are processed within 5–10 business days.
After the first 30 days, all payments are final. Partial months are not prorated.
You agree to use our services only for lawful purposes and in accordance with our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of the AUP can result in immediate suspension or termination without refund.
You own all content, data, and files you upload to our infrastructure. You grant Rovehost a limited, non-exclusive license to host, store, transmit, and back up your content solely as necessary to provide the services. We do not claim ownership of your content and will not access it except to provide support, ensure compliance with these Terms, or as required by law.
We perform daily automated backups with retention periods of 7 days (Starter), 30 days (Growth), and 60 days (Scale). These backups are a best-effort service. They are not a substitute for your own independent backups. We strongly encourage you to maintain your own off-site copies of important data. We are not liable for any data loss resulting from backup failure or corruption.
Rovehost and its logos, website design, and proprietary software are owned by Rovehost and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding.
Any custom development work delivered to you under a Custom AI Dev engagement belongs to you upon full payment, unless the applicable statement of work says otherwise.
Services are provided “as is” and “as available.” We do not warrant that services will be error-free, uninterrupted, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
To the fullest extent permitted by applicable law, Rovehost’s total liability to you for any claims arising from or related to these Terms or our services will not exceed the total fees you paid to us in the 12 months before the event giving rise to the claim.
We will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — even if we were advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless Rovehost and its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of our services, your content, or your violation of these Terms.
You may cancel your account at any time as described in Section 4. We may suspend or terminate your account at any time for violation of these Terms or our AUP, with or without prior notice. Upon termination, your access to the services ends and we will delete your data following the retention schedule in our Privacy Policy.
In the event of termination by us without cause, we will provide a prorated refund of prepaid fees for the unused portion of your current billing month.
We may update these Terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Your continued use of the services after the effective date constitutes acceptance of the updated Terms. If you disagree with a change, your remedy is to cancel your account before it takes effect.
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
Informal resolution first. Before initiating any formal dispute, you agree to contact us at [email protected] and give us 30 days to resolve the issue informally.
Binding arbitration. If we cannot resolve the dispute informally, you and Rovehost agree to resolve it through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will take place in Los Angeles County, California. The arbitrator’s decision is final and enforceable in any court of competent jurisdiction.
Carve-outs. Either party may seek emergency injunctive relief or pursue claims related to intellectual property infringement in court without going through arbitration first.
Class action waiver. You waive any right to bring or participate in any class action, collective action, or representative proceeding. Disputes must be brought on an individual basis only.
Opt-out. You may opt out of the arbitration and class action waiver provisions by emailing [email protected] within 30 days of first accepting these Terms. Your opt-out must include your name, account email, and a clear statement that you are opting out of arbitration.
